Welcome to Response (“we,” “our,” “us”). By accessing or using our AI Answering Service (“Service”), you agree to the terms below. If you do not agree, do not use the Service.
Service Overview
Response provides AI-powered call answering, messaging, transcription, and related services to small businesses. The Service operates on a monthly subscription basis.
Account Registration & Customer Responsibilities
You must provide accurate information, including name, email, phone number, and payment method.
You are responsible for securing your account credentials.
You are responsible for ensuring your use of our services complies with all applicable laws, including but not limited to privacy laws, consumer protection laws, and telemarketing regulations (e.g. TCPA, CAN-SPAM, CCPA if applicable).
Subscription, Billing & Free Trial
All plans renew automatically on a monthly basis unless canceled.
We offer a 25-minute free trial. No charges are made until the trial ends.
Subscriptions are billed in advance.
Refund Policy
We offer full refunds only if there is a verified technical failure that cannot be resolved within a reasonable time.
No partial refunds are provided.
All refund requests must be made within 7 days of the billing date.
Chargebacks & Disputes
Small-dollar chargebacks may be refunded without dispute.
Larger disputes will be reviewed case-by-case.
If service was delivered as promised, we reserve the right to challenge chargebacks.
Failed Payments
Failed payments are retried 3 times over 7 days via Stripe.
During this time, we will send SMS and email reminders.
If payment is not received after retries, your account will be paused, and all services (calls, texts) will stop until payment is resolved.
Acceptable Use Policy
You agree not to:
Use our services to send spam, scam messages, or harass anyone.
Use the Service to violate any local, state, or federal laws.
Use the system for illegal robocalls, deceptive advertising, or misrepresenting your identity.
Call Recording, Monitoring & Quality Control
Calls may be recorded and transcribed to deliver the Service.
Our team may monitor and review call recordings for internal quality assurance, support troubleshooting, and training purposes.
You are responsible for informing your customers of any required call recording disclosures in your state or jurisdiction.
By using the Service, you grant us permission to use anonymized call data to train and improve our AI systems and service performance across all clients.
Service Limitations & Availability
While we strive for 99.9% uptime, we do not guarantee uninterrupted service.
We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.
Third-Party Integrations & Call Transfers
If you choose to connect Response to third-party tools (e.g., CRMs, calendars, or scheduling platforms), you authorize Response to access those systems solely to perform your requested tasks (e.g., schedule appointments, log leads).
You remain responsible for the setup, security, and compliance of those third-party platforms.
When our system transfers a live call to you or a member of your team, Response acts only as an intermediary. We are not responsible for conversations or actions taken after the transfer.
We are not liable for any errors, outages, or data issues that originate from third-party systems or your connected platforms.
Limitation of Liability
We are not liable for any indirect, incidental, punitive, or consequential damages, including lost revenue, profits, or business opportunities.
Maximum liability for any claim will not exceed one month of paid service fees.
Termination
You may cancel anytime through your customer portal.
We reserve the right to terminate your account for violations of these Terms or applicable law.
Governing Law
These terms are governed by the laws of the State of Utah, without regard to conflict of law principles.
Modifications
We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance.
